1. About Rincón Water Safety


Rincón Water Safety Organization, Corp. (“RWS,” “we,” “our,” or “us”) is a nonprofit organization organized under Section 501(c)(3) of the Internal Revenue Code and based in Rincón, Puerto Rico.
 

These Terms & Conditions govern your access to and use of our website, programs, educational materials, seminars, and related services.

By accessing this website or participating in any RWS activity, you agree to these Terms.
 

2. Educational Purpose Only – No Rescue Services


RWS provides:
 

  • Water safety education

  • Risk awareness seminars

  • Community preparedness initiatives

  • Safety recommendations and advisory services
     

RWS does not provide continuous lifeguard services, supervision, or guaranteed emergency response unless explicitly stated in a separate written agreement.

Participation in ocean activities is undertaken at your own risk.
 

Nothing on this website or in our programs creates a duty of care, contractual rescue obligation, or supervision responsibility.
 

3. Assumption of Risk


Ocean environments involve inherent and unpredictable risks, including but not limited to:
 

  • Rip currents

  • Shore break and heavy surf

  • Submerged hazards

  • Marine life

  • Weather changes
     

By participating in any RWS educational event, seminar, or coastal activity, you acknowledge and voluntarily assume these risks.
 

4. No Guarantee of Safety Outcomes


RWS provides educational tools and guidance to improve awareness and preparedness. However:
 

  • We do not guarantee prevention of accidents

  • We do not guarantee emergency response

  • We do not guarantee specific safety outcomes
     

Users and participants remain solely responsible for their decisions and actions.
 

5. Hotel, Government & Institutional Advisory Services


Where RWS provides advisory services to hotels, municipalities, or other institutions:
 

  • Services are consultative and educational in nature

  • RWS does not assume operational control of beaches

  • RWS does not replace governmental lifeguard systems

  • Implementation decisions remain the responsibility of the contracting entity
     

Any formal engagement requires a separate written agreement.
 

6. Donations


RWS is a registered 501(c)(3) nonprofit organization.
 

Donations:
 

  • Are voluntary

  • Are non-refundable unless required by law

  • Support educational and safety initiatives
     

Tax deductibility is subject to applicable law. Donors should consult their tax advisor.
 

7. Intellectual Property


All content on this website, including:
 

  • Logos

  • Text

  • Graphics

  • Training materials

  • Educational frameworks
     

is the property of Rincón Water Safety Organization, Corp. and may not be reproduced without written permission.
 

8. Website Use


You agree not to:
 

  • Misuse the website

  • Attempt unauthorized access

  • Interfere with site functionality

  • Use content for commercial exploitation without permission
     

We reserve the right to restrict or terminate access if misuse occurs.
 

9. Limitation of Liability


To the fullest extent permitted by law:
 

RWS, its directors, officers, volunteers, instructors, and affiliates shall not be liable for:
 

  • Personal injury

  • Death

  • Property damage

  • Indirect or consequential damages
     

arising from participation in activities, reliance on educational materials, or use of this website.
 

10. Governing Law


These Terms are governed by the laws of Puerto Rico and applicable federal laws of the United States.
 

11. Modifications


RWS reserves the right to modify these Terms at any time. Updates will be posted on this page.
 

Continued use of the website constitutes acceptance of any changes.
